Terms and Conditions

1. This competition (Competition) is conducted in New Zealand by Devina Jackson of Mike Pero Mortgages Nelson 16 Bridge Street, Nelson (Tel: 021 338 462) (Promoter).
2. This Competition commences on Thursday 15 February 2024 and closes at 11:59pm (NZDT) on Thursday 21 March 2024 (Competition Period).
3. This Competition is open to individuals who:

a. are Nelson and Tasman residents in New Zealand;

b. are aged 18 years or older;

c. have not breached these Terms and Conditions; and

d. are not ineligible under clause 4, which applies to individuals with existing relationships with us.

4. Employees (and their immediate families) of the Promoter or its related entities, or of any other organisation associated with this Competition (for example, prize suppliers associated with this Competition) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. Related entity means related within the meaning of the Companies Act 1993.

How to Enter

5. To enter, individuals must book a no obligation chat with Scott Jackson or Devina Jackson by 11.59pm (NZDT) 21 March 2024. This chat can be booked via mikepero.co.nz or over the phone with Scott Jackson or Devina Jackson.
6. All entries must be submitted by a natural person and automated entries, unauthorized entries or entries by persons using an alias are invalid.

Prize Draw and Winner Notification

7. On Friday 22 March 2024 at 10:00am (NZDT), the Promoter will draw all prize winners at 16 Bridge Street, Nelson (Draw Location).
8. The winners will be randomly selected from entries received prior to 11:59pm (NZDT) on Thursday 21 March 2024.
9. The Promoter shall notify the winner by email or by phone, and publish the name of the winners on the Promoter’s Facebook page by 10:00am (NZDT) on 22 March 2024.
10. Prizes instructions will be sent via email by 10:00am (NZDT) on 25 March 2024 as long as the recipient has accepted the prize.
11. A winner must accept the prize by 5:00pm (NZDT) on 26 March 2024 by responding to the email or answering the phone call. If a winner has not accepted the prize by this time, the prize is forfeited, and a new winner will be drawn by the Promoter. The Promoter will contact the new winner by email or phone.) and publish the name of the new winner on the Promoter’s Facebook page by 10:00am (NZDT) on 27 March 2024.

The Prize

12. There are two prizes available – two corporate tables to the first two Nelson Giants basketball games each valued at approximately $900. The corporate table includes 6 x entry into the game, a cheeseboard, sandwiches, hot canapes, fruit, chocolate brownie, soft drinks, water, licensed beer and wine. A table will be given away for each game at the Promoter’s discretion. The first game will take place at 5:30pm (NZDT) on 31st March 2024 and the second game at 3:00pm (NZDT) on 6th April 2024.
13. Each prize (or any unused portion of the prize) is not transferable, exchangeable or redeemable for cash. The prize must be taken as offered and may not be varied.
14. The Promoter, in its discretion, reserves the right to substitute the prize with another prize to the equal value and/or specification if the prize is unavailable, or subject to any requests from a regulatory authority.
15. Each winner is responsible for understanding and complying with their taxation obligations in relation to the prize.
16. Travel and accommodation expenses are the sole responsibility of the winners.
17. By entering this Competition, entrants agree they will take all reasonable steps requested by the Promoter and Nelson Giants to enable delivery of the prize.

Miscellaneous Provisions

19. Participation in this Competition is acceptance of these Terms and Conditions.
20. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of these Terms and Conditions generally.
21. Each entrant acknowledges that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of an entrant’s ineligibility to enter after the Promoter has awarded a prize to the ineligible entrant. Return of a prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.
22. By participating in this Competition, entrants:

a. Agree to hold harmless, defend and indemnify and fully release Meta from and against any and all claims, demands, liability, damages or causes of action, losses, costs or expenses, with respect to or arising out of or related to:

i. their participation in the Competition, or

ii. their participation in any prize related activities, acceptance of a prize and/or use or misuse of a prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s); and

b. Acknowledge that this Competition and associated promotion is not sponsored, endorsed or administered by, or associated with Meta.

23. If for any reason this Competition is not capable of running as planned for any reason, including without limitation technical failure, tampering, unauthorized intervention, fraud, or any other matter beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition or the reputation of this Competition or that of the Promoter, the Promoter may cancel, terminate, modify or suspend this Competition.
24. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including their eligibility to enter) and to disqualify any entrant whose entry is not in accordance with these Terms and Conditions, who interferes improperly in the administration, integrity or conduct of the Competition or who otherwise tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided by law.
26. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of participation in the Competition including without limitation:

a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

b. any theft, unauthorised access or third party interference;

c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

d. any tax liability incurred by a winning entrant; or

e. acceptance or use of a prize.

27. The laws of New Zealand apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New Zealand.
28. The Promoter’s decisions in relation to this Competition are final and no correspondence or communication will be entered into in relation to any aspect of this Competition.

Privacy

30. By accepting the prize, a winner consents to the Promoter and Mike Pero (New Zealand) Ltd and its related companies using their name, and image in the event they are a winner (including photograph) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

31. When an entrant enters this Competition, the Promoter may collect the personal information the entrant provides. If an entrant wins the Competition, the Promoter may collect further information about the entrant.

32. The Promoter may use the information provided by an entrant to administer the Competition, fulfil the prize and to promote their products and services and those of their partners. The Promoter may also use an entrant’s personal information to conduct research and plan and develop product and marketing strategies, and any other purpose explained in these Terms and Conditions.

33. Without some or all of this information, an entrant may not be able to participate in the Competition or receive the prize.

34. The Promoter may disclose an entrant’s personal information to:

a. Entities who assist the Promoter in administering the Competitionand fulfilling the prize, and other prize suppliers and deliverers;

b. Marketing, research, and communications agencies;

c. Its related companies, who will use and disclose it for similar purposes as the Promoter’s

d. The authorities responsible for the regulation of gaming and lotteries and other government agencies, where applicable; and

e. Other parties where required by law.

34. The Promoter will not disclose an entrant’s information overseas in the course of this Competition.
35. The Promoter and its related companies will manage an entrant’s information in accordance with the Mike Pero Mortgages Privacy Policy. This explains how to request access to and correct or update information we hold about you, how to raise a complaint about privacy and how we will deal with your complaint.
